PRIVACY NOTICE FOR CALIFORNIA RESIDENTS

Effective: September 26, 2023This California Privacy Policy describes Impossible Foods Inc.’s (“Impossible Foods,” “we,” “us,” or “our”) practices regarding the collection, use, and disclosure of the personal information of California residents (“Consumers”), describes the rights of Consumers under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (“CPRA”), and explains how Consumers may contact Impossible Foods to exercise those rights. This policy only applies to the personal information of Consumers (i.e., California residents).Consumer RightsThis section describes certain rights of Consumers under the CPRA. For information on how Consumers may contact Impossible Foods to exercise these rights, please see the section below entitled, “How to Submit a Request.” Right to KnowA Consumer has the right to request that a business disclose what personal information it collects, uses, discloses, sells or shares. Specifically, a Consumer may request that a business that collects personal information about the Consumer disclose to the Consumer the following:

1. The categories of personal information it has collected about that Consumer.

2. The categories of sources from which the personal information is collected.

3. The business or commercial purpose for collecting, selling or sharing personal information.

4. The categories of third parties with whom the business discloses personal information.

5. The specific pieces of personal information it has collected about that Consumer.

A Consumer may request that a business that sells or shares the Consumer’s personal information, or that discloses it for a business purpose, disclose to that Consumer:

1. The categories of personal information that the business collected about the Consumer.

2. The categories of personal information that the business sold or shared about the Consumer and the categories of third parties to whom the personal information was sold or shared, by category or categories of personal information for each third party to whom the personal information was sold or shared.

3. The categories of personal information that the business disclosed about the Consumer for a business purpose and the categories of persons to whom it was disclosed for a business purpose.

Right to Request Deletion

A Consumer has the right to request that a business delete any personal information about the Consumer which the business has collected from the Consumer. If it is necessary for Impossible Foods to maintain the personal information for certain purposes, we are not required to comply with your deletion request. If we determine that we will not delete your personal information when you request us to do so, we will inform you and tell you why we are not deleting it.

Right to Opt-Out of Sale or Sharing of Personal Information

Impossible Foods does not sell Consumers’ personal information for monetary consideration. However, the collection of data through certain third-party cookies for Impossible Foods’ targeting advertising purposes may be considered a “sale” and is considered “sharing” under the CPRA. While Impossible Foods does not sell or share Consumers’ personal information for monetary consideration, we do use third party cookies for website analytics and targeted advertising purposes. To opt-out of having your information sold and/or shared with third party website analytics and digital advertising vendors, click the “Do not sell or share my personal information” link at the bottom of the main webpage.Please note that the above opt-out works by placing a web cookie on your computer to indicate your preference to opt-out from third-party tracking. If you clear your cookies or visit the website from a different device or using a different browser, your preference will not be saved. To opt out from other browsers and devices, you will need to repeat the opt-out process in such browsers and devices. Furthermore, the above opt-out only applies to Impossible Food's website and does not impact tracking on third party websites or with respect to third party content.Right to Correct Inaccurate Personal InformationA Consumer has the right to request a business that maintains inaccurate personal information about the Consumer to correct that inaccurate personal information, taking into account the nature of the personal information and the purposes of the processing of the personal information.Right to Limit Use and Disclosure of Sensitive Personal InformationA Consumer has the right to direct a business that collects sensitive personal information as defined under the CPRA about the Consumer to limit its use of the Consumer’s sensitive personal information (1) to that use which is necessary to perform the services or provide the goods reasonably expected by an average consumer who requests those goods or services; (2) for certain business purposes; and (3) as authorized by the implementing regulations of the CPRA. Impossible Foods does not collect Consumers’ sensitive personal information.No DiscriminationA Consumer has the right not to be discriminated against because the Consumer exercised any of the Consumer’s rights under the CPRA. Impossible Foods may charge a Consumer a different price or rate, or provide a different level or quality of goods or services to the Consumer, if that difference is reasonably related to the value provided to the Consumer by the Consumer’s data.How to Submit a RequestTo exercise the rights described above, you must submit a verifiable Consumer request to us. Please include “CPRA” in the subject line and detail your request in the body.You may submit a request as frequently as you would like, but we are not required to respond to requests to provide personal information to you more than twice in any 12-month period. If you maintain an online account with us, we will verify your identity for a request through the normal account authentication process, meaning you will need to sign on with your username and password. To submit a verifiable Consumer request, you will be asked to provide certain information to help us verify your identity. If you plan to submit your request via email, we will require you to email us from the email address you previously provided to us or used to communicate with us. If you submit your request online, we will require you to confirm your request through the email address you provide in the request form. You may make a verifiable Consumer request on behalf of your minor child. You may also designate an authorized agent to make a request on your behalf by submitting your authorization to us via a verified form of communication, such as through the email address you previously provided to us or previously used to communicate with us.If we cannot verify your identity or authority to make the request, we will not be able to comply with your request. We will inform you if we cannot verify your identity or authority. We will only use personal information provided in a verifiable Consumer request to verify the requestor’s identity or authority to make the request.   • To provide our products and services to you and activities related to our provision of such products and services, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing advertising or marketing services, or providing analytics services;

  • To fulfill orders purchased through the website and sending related communications;

  • To improve, upgrade, or enhance our products and services;

  • To provide you with information about products and services that we may provide that we think may be of interest to you;

  • To enable you to participate in our Program and Sweepstakes (as such terms are defined below);

  • To detect security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity; and

  • To debug to identify and repair errors that impair existing functionality.

Impossible Foods will retain the above personal information for as long as necessary to fulfill the purpose for which it was collected, or as required by applicable laws or regulation.

Financial Incentive ProgramsImpossible Foods offers financial incentive programs relating to Consumer personal information. We currently offer a loyalty program in which Consumers receive points that are redeemable for both monetary and non-monetary rewards whenever the Consumer completes a survey, refers a friend, or sends us a picture of their receipt or their Impossible food item (the “Program”). Consumers may opt-in to the Program at any time at impossiblefoods.com/tasteplace which describes the material terms of the Program. Consumers may revoke their decision to opt-in at any time by clicking on the cookie icon in the lower right hand corner of the page. We also offer sweepstakes in which Consumers may win a trip for up to four to Walt Disney World Resort or win free Impossible foods for a year by providing their name, address, email address and uploading a copy of their receipt of an Impossible foods purchase (“Sweepstakes”). Consumers may opt-in to the Sweepstakes at any time at www.impossiblesweepstakes.com(opens in a new tab). Consumers may revoke their decision to opt-in at any time by contacting us here(opens in a new tab). In determining the value of the data to Impossible Foods collected through the Program and Sweepstakes, we consider the value generated from providing a more personalized marketing experience that is based on personal information (as defined by CPRA), which is reasonably correlated to the value provided to the consumer through both monetary and non-monetary rewards.
